Terms and Conditions of Use
1. Website Owner
The website www.overlowcarb.it (hereinafter, the “Website”) is an e-commerce platform dedicated to the sale of low-carb baked goods and is operated by the individual firm Magic Baker di Aste Roberto, with registered office in Italy (hereinafter, the “Seller”).

2. Scope of Application
These General Terms and Conditions of Sale govern all sales contracts for products marketed by Magic Baker concluded through the Website, as well as through alternative channels (telephone, e-mail, or other remote communication means).
Anyone making a purchase is considered a "Customer" for the purposes of these Conditions.
3. Acceptance of Conditions
By submitting the order, the Customer declares to have read, understood, and fully accepted these General Terms and Conditions of Sale.
These Conditions prevail over any general or specific conditions of the Customer, unless expressly agreed otherwise in writing.
The Customer undertakes to provide correct, complete, and updated personal data, assuming all responsibility for the truthfulness of the information provided.
4. Amendments to the Conditions
Magic Baker reserves the right to amend these General Terms and Conditions of Sale at any time. The amendments will be effective from the date of publication on the Website and will apply exclusively to orders placed thereafter.
5. Products
The products for sale are described within their respective product pages on the Website.
Images are for illustrative purposes only and may not accurately represent the final product.
All products comply with current Italian and European food regulations. Any nutritional information, ingredients, and allergens are listed on the product pages and labels.

6. Prices
All prices are expressed in euros (€) and include VAT.
Shipping costs are not included in the product price and are indicated separately before order confirmation.
Magic Baker reserves the right to change prices at any time; however, the Customer will be charged the prices in force at the time of the order.
Any typographical or material errors in prices will not be binding for the Seller.
7. Shipping Costs
Shipping costs for Italy are automatically calculated based on the products added to the cart and the shipping conditions applicable to the order.
The exact amount of shipping costs is always shown to the Customer before completing the order and before payment.
Shipping is free for orders equal to or greater than €100.00.
Any temporary promotions on shipping costs will be clearly indicated on the Website.
8. Orders
There is no minimum order amount.
Before confirming the order, the Customer must:
- carefully check the entered data;
- ensure the correctness of the shipping address;
- communicate any changes within one hour of submitting the order.
The available payment methods are:
- PayPal and credit cards;
- cash on delivery, where applicable.
The submission of the order constitutes a contractual proposal.
9. Order Confirmation
Upon receipt of the order, the Customer will receive an automatic confirmation e-mail containing a summary of the purchased products.
The sales contract is considered concluded at the time the order confirmation is sent.
10. Invoicing
The invoice will be issued and sent with the shipment or, upon request of the Customer, via e-mail.

11. Processing and Delivery Times
Orders received by 5:00 PM are typically processed within 7 working days, subject to product availability.
Courier delivery times average 48 hours from the time of shipment collection.
Shipments are made from Monday to Thursday. Orders received after 5:00 PM on Thursday will be processed starting from the following Monday.
12. Transport Conditions
Delivery is understood to be made at street level.
For special needs (deliveries to upper floors or complex access), the Customer is invited to contact Customer Service in advance.
13. Goods Verification and Warranty
Upon delivery, the Customer is required to check the integrity of the packaging.
In case of visible anomalies or damage, delivery must be accepted with reservation.
Any complaints must be communicated within 7 days of receipt of the goods via e-mail or telephone.
Returns must be pre-authorized by the Seller and accompanied by shipping documentation.
14. Right of Withdrawal
Pursuant to Legislative Decree 206/2005 (Consumer Code), the consumer Customer has the right to withdraw from the contract within 14 days of receipt of the products.
The right of withdrawal does not apply to Customers holding a VAT number.
The withdrawal communication must be sent by registered mail with return receipt or certified e-mail (PEC).
The goods must be returned intact, unused, in their original packaging, and accompanied by a receipt or invoice.
Return shipping costs are borne by the Customer.
15. Refunds
The refund will be issued within 14 days of receipt of the returned goods, via bank transfer.
Shipping costs and any ancillary costs incurred will be deducted from the refund.
16. Limitation of Liability
Magic Baker will not be liable for delays or defaults due to force majeure, such as, by way of example: natural events, fires, strikes, interruptions of transport services, or unpredictable events beyond its control.
In such cases, the Customer will only be entitled to the return of any amount already paid.
Magic Baker is not responsible for improper or non-compliant use of purchased products, nor for damages resulting from incorrect storage of the same by the Customer.
17. Dispute Resolution – ODR Platform
In case of disputes, the consumer Customer can resort to the European online dispute resolution platform (ODR), accessible at:

18. Applicable Law and Competent Jurisdiction
The sales contract is governed by Italian law.
For any dispute, the court of the consumer's place of residence or domicile, if located in Italy, shall have jurisdiction.
